We are excited to offer you exceptional design services at an affordable price. Our policies are designed to be fair to all involved. Please read the Terms & Conditions thoroughly. This agreement or terms and conditions governs your use of this website, services, features, and content provided through the website and service. By purchasing goods/consultation services from Larry Travis Designs, participating in our website’s services, and/or accessing our website content, you are agreeing to these Terms & Conditions, which are incorporated herein by reference.  If you do not agree with the Terms & Conditions, you may simply refrain from using the website or service. By your continued use of the site, you are deemed to have read and accepted the following Terms & Conditions and agree to comply with and be bound by all applicable laws and regulations. It is your responsibility to review these terms periodically. We may revise these terms at any time without notice to you.

1. USE OF THE SITE

Use of our website must be consistent with the intended use and is not for any illegal or unauthorized purposes. The content of our website is the intellectual property of Larry Travis Designs. You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this website or any portion of its content, including, but not limited to, code, creative content, pictures or images, logos, characters, or copy of any content of our website. Larry Travis Designs reserves the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation, if Larry Travis Designs believes that your conduct violates applicable law or is harmful to Larry Travis Designs interests.

This site may be accessed from countries other than the United States. This site may contain products or references to products that are not available outside of the United States. Any such references do not imply that such products will be made available outside the United States. If you access and use this site outside the United States, you are responsible for complying with your local laws and regulations.

2. HOW WE USE YOUR INFORMATION

We may use any data submitted by you or obtained from you to fulfill requested services such as purchasing, billing, and shipping. Any personal contact information provided may be used for the purpose of contacting you regarding your order or design execution. Promotional information and special offers will only be issued to those who have voluntarily provided their contact information.

By submitting information to Larry Travis Designs through the site or service, including photos, digital files, blueprints, architectural renderings, or other data, you agree that Larry Travis Designs can use such data in connection with its business including for marketing purposes as well as on social media (TikTok, Instagram, Twitter, Facebook, Pinterest, etc.) and blog content. You also confirm that all photos, digital files, blueprints, architectural renderings, and other data submitted to Larry Travis Designs are original and will not infringe on the intellectual property rights of any third party, and correct permission has been granted by the homeowner, architect, firm, photographer, or other owner of such data sufficient to allow Larry Travis Designs to use such data in accordance with these Terms & Conditions. 

Larry Travis Designs will not be held liable for copyright infringement based on any information or materials submitted by you. It is your responsibility to obtain permission for use of user content, if needed, and you agree to indemnify, defend, and hold harmless Larry Travis Designs and any of its directors, officers, agents, and employees from any loss, cost, liability, claim, cause of action, and expense (including attorneys’ fees and litigation costs) of any kind arising out of or relating to, in any way, directly or indirectly, the user content, including but not limited to infringement or misappropriation of the rights of any third parties.

Larry Travis Designs is not liable to you or any third party for consequential, incidental, or punitive damages, expenses or losses related to your use of our site, our consultation/advice, services, or our products sold, regardless of any warranties or disclaimers.

3. MOBILE/WIRELESS POLICY

By providing your cell phone number and using the service, you hereby affirmatively consent to our use of your cell phone number for calls and texts to perform and improve upon the service. Larry Travis Designs will not assess any charges for calls or texts, but standard message charges or other charges from your wireless carrier may apply. Please consult your mobile service carrier’s pricing plan to determine the charges for browsing data and sending and receiving text messages. Under no circumstances will Larry Travis Designs, or its service providers be responsible for any text messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number due to a promotion. If your carrier does not permit text alerts, you may not receive Larry Travis Designs text alerts. Pre-paid phones or calling plans may not be supported. We will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an “AS-IS” basis. Data obtained from you in connection with this SMS service may include your cell phone number, your provider’s name, and the date, time, and content of your messages. We may use this information to contact you and to provide the services you request from us.

4. SERVICES AND PRICING

Larry Travis Designs is a virtual design (e-design) company that creates conceptual designs for interiors and exteriors to help clients visualize their spaces in an idealistic way. We do not advise on structural or construction components. These items are best discussed with a licensed contractor who will recommend ways to achieve the provided design or likeness thereof based upon the provided visual representation.

Because Larry Travis Designs is not involved in the physical construction or implementation of the design, you release Larry Travis Designs (and our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. This also includes any damages that may occur on the site of your home or business or surrounding area.

Larry Travis Designs prices, including prices for its service packages, are merely estimated amounts. Larry Travis Designs prices become finalized amounts when Larry Travis Designs confirms the actual size and scope of the project.

As a Larry Travis Designs client, you are given one free revision within 48 hours of the design being delivered. That said, the free revisional element(s) do include: door style or color, garage door style or color, lighting, shutter style or color, paint color, trim color, address numbers, and planters.

The free revisional element(s) do not include: front or back porch/deck structures, stairs, walkways, railings, roofline or gable changes, windows, landscape, hardscape (driveway or walkway). Additionally, cladding changes such as: stone to brick/ brick to stone, that includes siding, changing stone to different color or style, paint to limewash, siding direction from horizontal to vertical/ vertical to horizontal, etc are not included. Ultimately, the decision of what free revisional element(s) may be changed without additional costs is at the sole discretion of Larry Travis Designs.

Due note that there may be items on your design that are not specifically linked in the shopping/product list. Contractors may make recommendations, provide, or fabricate these on-site items. These additional items include, but not limited to corbels, gable accents, railings, awnings, trims, doors, windows, shutters, garage doors, pavers/walkway materials, columns, and wood headers. Please contact your local contractor or supply company for additional recommendations and to ensure proper fit and installation.

5. USER SUBMISSIONS

The site and service may permit the upload, submission, and distribution of texts, images, material, information, and communications by you and other users. You understand that whether such user submissions are published, Larry Travis Designs does not guarantee any confidentiality with respect to any such submissions.

By submitting the user submission(s) or displaying, publishing, or otherwise posting any content, including photographs, you hereby grant Larry Travis Designs a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable and transferable license to use, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the users submission(s) in connection with the site and Larry Travis Designs’s (and its successors and assigns) business, including without limitation for promoting and redistributing part or all of the site or service (and derivative works thereof) in any media formats and through any media channels.

You shall not upload, submit, distribute, or otherwise publish through this site any texts, images, communications, information, or other material that (a) violates or infringes the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under U.S. or international law; or (c) includes any bugs, viruses, worms, trap doors, trojan horses or other harmful code or properties.

You shall not submit any “deep-link,” “page-scrape,” “robot,” “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process to access, acquire, copy, or monitor the site or any portion of the content.

You shall not (a) send or otherwise post unauthorized commercial communications (such as spam) on the site or through the service, (b) engage in unlawful multi-level marketing, such as a pyramid scheme, on the site or through the service; (c) imply or state that any statements you make are endorsed by Larry Travis Designs, without the prior written consent of Larry Travis Designs, or (d) facilitate or encourage any violations of these Terms.

Content provided on this site is solely for informational purposes. User submissions or opinions expressed on this site are that of the individual expressing such user submission or opinion and may not reflect the opinions of Larry Travis Designs.

You shall be responsible for your user submissions and the consequences of posting or publishing them. You agree that Larry Travis Designs has no liability with respect to any user submissions, including, without limitation, your own user submissions. You hereby release Larry Travis Designs and its officers, directors, employees, agents, representatives, and present and future affiliates, from any and all liability arising out of or relating to user submissions or any part thereof.

Larry Travis Designs reserves the right to decide whether a user submission is inappropriate or violates this agreement. Larry Travis Designs also reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages and user submissions) by you, or to restrict, suspend or terminate your access to all or any part of the site at any time, for any or no reason, with or without prior notice.

6. BILLING, PAYMENTS, TAXES

For all purchases and payments, fees or expenses associated with the service, Larry Travis Designs will charge the user’s payment card according to the amount agreed upon between the user and Larry Travis Designs and the user hereby authorizes Larry Travis Designs, or its third-party payment processors, to charge its payment card for such amounts. Larry Travis Designs retains the right, in its sole discretion, to place a hold on any payment for the service.

Larry Travis Designs has no obligation to provide refunds or credits, but may grant them in extenuating circumstances, as a result of specific refund guarantee promotions, or to correct any errors made by Larry Travis Designs, in each case in Larry Travis Designs’s sole discretion.

Users may share relevant payment card information through the site to make purchases through the service. We use a third-party payment processor to manage and process payments you make through the service. Additional payment terms may be set by the third-party payment processor. The actual payment will not be completed until a third-party payment processor processes a users’ payment. Delay is possible. The third party payment processor shall store relevant payment information until directed to complete the transaction.

By using the site, you expressly authorize (a) the third-party payment processor to collect your payment information and access your transactions on the payment processor platform; (b) the payment processor to exchange and process merchant data and your data with the third-party payment processor; and (c) the third-party payment processor to exchange and process merchant and your data worldwide, internally or through a third party service provider, in each case as necessary to enable us to provide the design services.

You must provide current, complete, and accurate information for all orders placed and all payments made through the services. You must promptly update all information to keep your payment information current, complete, and accurate (such as a change in billing address, credit card number, or credit card expiration date). If the third-party payment processor does not receive payment from you for a purchase you make through the services, you agree to pay all amounts due by you upon demand. The full portion of payment is due prior to the rendering of services and delivery of product. 

User will be liable for all transaction taxes on the services provided under this agreement.

7. REFUNDS

We do not offer refunds on designs that are in process or that have been completed and/or delivered. However, Larry Travis Designs wants you to be completely satisfied with the final image of your home or business design. If you are not satisfied and would like to see changes, we offer one free revisional element(s) within 48 hours of receiving your rendering design.

If you would like more revisions, you may purchase those for an additional fee. Keep in mind, all landscape is generic unless noted otherwise and some items are best sourced locally. All home renderings, before and after photos, revisions, and digital files are exclusive property of Larry Travis Designs.

8. DISPUTE AND RESOLUTIONS

Please note: these terms in the “dispute resolution” section contains an arbitration clause that requires disputes to be arbitrated on an individual basis and prohibits class action claims. It affects how disputes between you and Larry Travis Designs are resolved. By accepting these terms, you agree to be bound by this arbitration provision.

Projects are kept in archives for 30 days after delivery. After that time, a revision of any kind will not be possible, and a new order will need to be placed.

It is the client’s responsibility to provide accurate information including dimensions. It is the client’s responsibility to provide a clear, high resolution, straight and level photo(s). It is the client’s responsibility to provide HOA, CCR, historical guidelines, and additional information that may be useful to the development of the services. Larry Travis Designs does not guarantee or responsible for permit approval or approval by the HOA, local, regional, national commissions, agencies, or any other authorized governing body. Larry Travis Designs is not responsible for inaccurate or incomplete information. Larry Travis Designs is not responsible for acquiring photos. Designs are created based on client submission, provided information, and architectural style. The design process starts immediately upon order. We do not offer refunds after orders are placed. This includes designs that are in process or that have been completed and/or delivered.

Larry Travis Designs suggests testing all colors and viewing all samples before painting or making changes. Actual colors of paint, siding, wood, stone, stucco, brick, or other cladding materials may vary. Every computer monitor has different capabilities to display different colors, and everyone sees colors differently.  We cannot guarantee the color you see accurately portrays the specified products or true color of the paint or home exterior material. Images submitted may be adjusted for exposure, brightness, sharpness, etc. at the discretion of Larry Travis Designs. Larry Travis Designs suggests testing and getting samples of recommendations, as the design may not reflect the color, texture, likeness, etc in your environment.

Images may be altered. Trees, brush, landscape, cars, bikes, boats, dumpsters, etc. may or may not be removed to display the image accurately. We cannot guarantee every part of the photo will be altered due to ability/inability to see clearly areas of the picture submitted.

All materials created by Larry Travis Designs, including but not limited to photo and digital files, shall be the exclusive property of Larry Travis Designs.

All inquiries, contact, and purchases made through our website and/or Larry Travis Designs are an offer to engage in communication or transaction with you, and we reserve the right to refuse any such interaction at any time. Larry Travis Designs reserves the right to publish any user content for marketing purposes. By submitting any user content, including, but not limited to, comments, reviews, messages, notes, suggestions, complaints, before and after photos you agree that the user content is non-confidential, does not violate any privacy, publicity or intellectual property rights and is granted to Larry Travis Designs for use as we determine, in our sole discretion. User content may be removed by Larry Travis Designs at any time.

Information provided for contact or purchasing purposes, including any personal information or credit card information, must be accurate and complete. Any purchases made on our website will be charged in full upon purchase unless otherwise noted. Prices listed on our website do not include any taxes or additional fees, if applicable. Larry Travis Designs does not guarantee availability of specified products, delivery of products, or delays in shipment or delivery. Any revision(s) needed by a client due to lack of product availability or substistution will incur an additional fee in the amount determined by Larry Travis Designs.

Any errors in pricing due to mathematical, typographical or invoice discrepancy, or errors in description, dimensions, color, availability or other specifications may be subject to correction. We do not guarantee the accuracy, completeness, consistency or reliability of any information provided, and do not guarantee that updates pertaining to any content, images or product description and/or details are current. We reserve the right to edit any inaccuracies.
